On Friday, July 4, 2025, the federal police in Mittenwald, Bavaria, checked a coach that had just entered the federal territory. During this check, the officers came across a 38-year-old passenger who was behaving suspiciously. During a search, several illegal items were seized: 22 counterfeit 50 euro notes, small amounts of cannabis, prescription medicines and a fake identity document, an Italian ID card. The man tried to get rid of the counterfeit money in a desperate attempt, but this did not stop officers from seizing the items. The federal police were supported by the veil investigators from the border police in Mittenwald, and the accused was taken into custody the following day. The criminal police in Garmisch-Partenkirchen have now taken over the investigation. Bavaria Police reports on successful cooperation between various authorities, which led to this successful investigation.
Legal provisions on counterfeiting money
The problem of counterfeiting money is not a new phenomenon and has existed since ancient times. According to the Criminal Code (StGB), counterfeiting is dealt with in paragraphs 146 and 147. Counterfeiting is a special form of document forgery and can only be committed intentionally. The paragraphs mentioned precisely define how counterfeit money is created and put into circulation. The law firm points out that placing counterfeit money on the market is a criminal offense if the perpetrator knows that it is counterfeit money.
Possession of counterfeit money is also a criminal offense, especially if it was done with the intention of putting the counterfeit money into circulation. According to Section 147 of the Criminal Code, a punishment of up to five years in prison or a fine can be expected. Commercial counterfeiting of money is punishable by a prison sentence of not less than two years. This shows how seriously the legislature views this issue.
Investigation procedure and consequences
The investigation into this incident relates not only to counterfeiting, but also to drug possession. This could have significant legal consequences for the 38-year-old man. If you are arrested for counterfeiting or similar offenses, you should urgently seek legal advice as you have the right to refuse to testify. At the same time, a house search is common and should be accepted without resistance.
In the case of counterfeit money, for example if someone accidentally pays with it, there is also the risk of an investigation. Banks do not refund counterfeit money because the recipient is considered a victim of a crime. It is therefore advisable to contact a bank or the police immediately if you have any doubts about the authenticity of banknotes.
